24 year old Cody Pahuta of Corfu was facing sentencing on a charge of attempted assault.
Pahuta allegedly beat an individual and kicked them while on the ground after they unwantedly came to his residence.
District Attorney Lawrence Friedman argued that he could have initially been facing a first degree assault charge for kicking the victim with footwear considered a deadly weapon, while his defense Jamie Welch claimed that if the victim did not lose a tooth in the incident it would only have been a third degree assault charge.
Pahuta was sentenced to one year in the Genesee County Jail.
