Police say Serrano was driving home from the Jason Aldean concert at Darien Lake when she struck and killed 18 year old Connor Lynsky.
Defense lawyers for Serrano said the stenographer covering the grand jury proceedings made an audio recording of the testimony which is not allowed. They want the case dismissed.
District Attorney Lawrence Friedman learned of the recording, notified the defense. Friedman believes, however, the recording will not jeopardize the case.
