Scheepers and Ardle Named Genesee Athletes of the Week

BATAVIA, NY… Sophomores Diante Scheepers from women’s soccer and Ollie Ardle from men’s soccer were named Genesee Athletes of the Week for the Week of October 14.

Diante Scheepers scored three goals against Finger Lakes to help the Cougars get the comeback victory over the Lakers. On the season, the sophomore from Willemstad, Curacao has nine goals and eleven assists in 12 games played.

Ollie Ardle is second on the team in goals with 10 and has started 15 games so far this season for Genesee. In the Cougars games against Finger Lakes and Fulton-Montgomery, Ardle has scored three goals and added three assists.

The Cougars are home on Tuesday against Mercyhurst Northeast starting at 4pm in the regular season home finale and then will play on the road at SUNY Broome Saturday.

Investigation by police in Warsaw into an alleged incident in the village has led to the lock-up of a 14 year old male in Warsaw on a count of Rape in the first-degree.
The teen allegedly assaulted a young female in a unfrequented outdoor location according to investigators.
The teen boy was apprehended on Frday October 4th following the investigation.
After arraignment in Wyoming County Court he was remanded to in lieu of $10,000 bail to the Erie County’s Youth Detention Center.

Three busted for Criminal Contempt in Batavia.
23 year old Brian Miles of Rochester was arrested on a City Court arrest warrant after allegedly failing to appear for a subpoena back in September.
He was jailed in lieu of 1,000 dollars bail.
45 year old Shannon Draper of Oak Street Pavilion was arrested on a count of Criminal Contempt after he was allegedly observed to be in the presence of a protected party that had an active Stay Away order of protection against him.
He was released with an appearance ticket for City Court at a later date.
Genesee County Sheriff’s took 34 year old Jennifer Button of Oakfield into custody for Criminal Contempt last week after she allegedly had sent text messages to a protected party.
Button was given an appearance ticket for Batavia Town Court on Nov 7th.

Several health groups are working together to try and show a court why a ban on the sale of flavored e-cigarettes is needed.
They’ve filed an amicus brief ahead of a hearing on the ban that’s set for Friday.
Earlier this month, the Vapor Technology Association and affiliates were able to get the ban put on hold.
Supporters say the ban is needed to help curb youth vaping rates.
Vape shop owners believe it would hurt their sales since flavored products are popular among customers.

State Police alert residents of increased deer versus car accidents.
Every October and November, Troopers handle an increased number of vehicles collisions striking deer in Troop A- Western New York.
Total reported collisions increased from 1,412 in 2017 to 1,523 total collisions in 2018.
Police encourage operators to use caution around dusk and dawn and say that if you are operating a vehicle and a deer enters the roadway do NOT swerve.
When an operator swerves to avoid a deer, the vehicle is more likely to strike another vehicle or exit the roadway striking trees or utility poles.
Troopers say that if you strike a deer, remain at the scene and call 911.

The Buffalo Sabres are on the west coast in search of yet another win.
They’ll be in Anaheim tonight to take on the Ducks at the Honda Center.
The Sabres have won five of their first six games and are coming off a victory over the Dallas Stars Monday.
Face off for tonight’s contest is set for 10 p.m.

Gia’s Surreal goes coast to coast in Batavia distaff Open

Batavia, NY — 3-year-old Gia’s Surreal had been a solid campaigner all year on the New York Sire Stake circuit, culminating that series with a second place finish in the Excelsior “A” final in September. Since that start the filly has won three straight races in overnights against aged mares and on Monday (Oct. 14) knocked off the track’s top class, the $12,000 Open Handicap pace for fillies and mares at Batavia Downs.

Driver Jim Morrill Jr. left fast with Gia’s Surreal and led the ladies to the quarter in :27.4 and the half in :57.2. As the race proceeded onto the second circuit, Little Joke (Billy Davis Jr.) and Kaitlyn Rae (Mike Caprio) moved up on the rim to apply some pressure and pushed a fast :28.2 split to the three-quarters. But Gia’s Surreal, who had maintained a 1-1/4 length lead the entire race, stayed stout and kept to her business which was turning back all challengers and pacing home strong to win in 1:55.

Gia’s Surreal ($3.10) scored her ninth win in 19 starts this year and pushed her stake-enhanced earnings to $83,869 for owners Jim Graham, Edward Peron, Lee Winters and Thomas Mariano. Jim Graham trains the filly.

Gia’s Surreal was one of three wins for Jim Morrill Jr. on Monday. Billy Davis Jr. also got the driving hat trick on the card.

Racing resumes at Batavia Downs on Friday (Oct. 18) at 6 p.m. There is no racing this Wednesday (Oct. 16) due to today’s special matinee card.

A Genesee County Grand Jury has indicted Michele R. Williams of driving drunk in Darien with 5 children.
Williams is accused of driving a 2013 Chevrolet on Route 77 back on May 24th of this year while having a BAC of .08 percent or more and accompanied by 5 kids all reportedly 15 years of age or less.
Out of the eleven count indictment 10 are class E felony counts of Aggravated DWI with a child in the vehicle.
Williams was also hit with a single traffic infraction for following too closely.

The Grand Jury also indicted Taraleen Tundo for Aggravated DWI with a child in the vehicle.
She allegedly had a passenger that was 15 year of age or less when she was stopped in her 2004 Ford on Rt. 5 in Stafford on May 1st and arrested for driving while impaired by a combination of drugs.
Also included in the indictment against Tundo are counts of Criminal Possession of a Controlled Substance for allegedly possessing Suboxone illegally and of Criminally Using Drug Paraphernalia for allegedly possessing or selling packaging material for the individual packaging of quantities of narcotic drugs.

Brian Dyer faced an indictment by the Genesee County Grand Jury for counts of first-degree Assault, a Class B violent felony and Criminal Possession of a Weapon, a Class D felony.
Dyer allegedly caused serious physical injury to another person with the use of a concrete statue as a dangerous instrument on July 5 in Batavia.

State residents will soon be able to apply for their driver’s license online.
Governor Cuomo is giving the green light to the online option which allows prospective drivers to take a required five-hour training and instruction course without leaving home.
The online option is set to start in June and run until at least 2025, unless it’s extended by the governor or legislature.
Some driving schools have spoken out against the online course, claiming it’ll hurt their business.

Starting this week, members of the state Senate will begin holding roundtables to discuss New York’s school funding formula.
Those calculations haven’t been significantly changed since the current system was launched in 2007.
Senate Majority Leader Andrea Stewart-Cousins says real discussions are needed on how the state’s roughly 950 school districts are funded.
The Western New York forum is set for this Friday from ten a-m until two p-m at the Roswell Comprehensive Cancer Center on Elm Street in Buffalo.

The Buffalo Sabres are red-hot to start the new NHL season.
Victor Olofsson, Marcus Johannson, Jeff Skinner and Sam Reinhart all scored in the Sabres’ four to nothing win over the Dallas Stars at KeyBank Center yesterday.
Buffalo has won five of its first six games for the franchise’s best start in several seasons.
They’ll now be heading west to take on the Anaheim Ducks tomorrow night.

Mr. Euroman captures Batavia top pace

Batavia, NY — Mr. Euroman had a two-month vacation this summer before the start of the Batavia Downs meet and since returning to action in late August, has won four out of his eight starts in Genesee County. The most recent win came on Saturday night (Oct. 12) in the $12,500 Open Handicap pace at the Downs.

Leaving from post one, Mr. Euroman (Billy Davis Jr.) watched as Sir Pugsley (Drew Monti) fired off the gate and took command of the race heading around the first turn. With the field in single file, Sir Pugsley went down to the half in :57 before stepping up the pace to the three-quarters with a :27.3 split. Mr. Euroman was the beneficiary of cover to this point of the race and continued to trip-out to the top of the stretch. Davis pulled the pocket at the head of the lane with Mr. Euroman and out-dueled Sir Pugsley to the wire to win by one-half length in 1:53.2.

It was the seventh win of the year for Mr. Euroman ($16.00) who is owned by Vogel and Wags Nags, Jack Rice and Adelphi Bloodstock and is trained by Maria Rice.

There were a pair of $11,000 Open II races on the card that both provided some stellar performances.

Down On My Luck

The first split saw Down On My Luck (Drew Monti) get away third before pulling first-over at the three-eighths, clear the leading Barry Hanover (Dave McNeight III) by the three-quarters and then pull away to an easy 2-¼ length win in 1:53.3. Down On My Luck ($3.10) is having a career year for owner Robert Woodburn, now with eight wins and $47,867 in earnings. Patrick Shepherd trains the winner.

What’s Goin On

In the second division, What’s Goin On (John Cummings Jr.) sat second behind the pace-setting Rise Up Now (Shawn McDonough) from the start until the top of the stretch where he found room on the pylons and shot through like a rocket to out-pace four other fast finishers and win by one-half length in 1:54.4. What’s Going On ($8.70) now also has eight wins this year and $65,821 earned for owners Marissa and Joe Russo. David Russo does the conditioning.

Drew Monti scored a driving triple to lead all drivers on Saturday while John Cumming Jr. and Renaldo Morales III scored two wins apiece. Trainer Patrick Shepherd also sent three horses to the Purple Haze Winner’s Circle while James Clouser Jr. and Joe Skowyra each watched two of their stable win during the night

Racing resumes at Batavia Downs with the final matinee card of the year on Monday (Oct. 14) with the annual Columbus Day special. Post time for the first race is 1:15 p.m.

GCC Athletics Update: Men’s Soccer

JOHNSTOWN, NY… The no.7 Genesee Community College Cougars earned their 12th win of the season and their second consecutive road victory as they defeated the Fulton-Montgomery Community College Raiders 6-1 Saturday afternoon.

The Cougars had six different goal scorers in their NJCAA Region III contest against the host Raiders. Ryan Curtis, Robert Keogh, James Lighton, Hiago Barros de Souza, Ollie Ardle, and Futa Kubo all found the back of the net. Ed Port had a game-high three assists.

Marcus Kenline and Adam Willig split time in net for the Blue and Gold.

Genesee (12-3) returns home for their regular season home finale on Tuesday, October 15 at 6:30pm against WNYAC foe Mercyhurst Northeast.

$6,000 Guaranteed Pick-5 Saturday at Batavia

The Pick-5 wager begins in race one and runs through race five. It is a 50-cent base wager and if all five winners aren’t selected, the carryover amount will move to the Monday program.

35 year old Nathan Falsone of East Main Street in the City is behind bars after investigation into a violated protection order and a domestic incident.
Falsone was taken into custody on a count of Criminal Contempt late Wednesday morning after allegedly violating an order of protection at a Maple Street address in Batavia.
Falsone was additionally charged with Criminal Mischief and Unlawful Imprisonment stemming from an alleged domestic incident at an East Main Street apartment that occurred earlier that morning.
He was committed in lieu of bail to the Genesee County Jail and is scheduled to reappear on October 24th in Batavia City Court.

City Police net two drunk drivers over the Columbus Day weekend.
Following a personal injury motor vehicle accident just after midnight Friday on East Main Street Police apprehended 21 year old Tessa Engel of Wade Ave Batavia.
She is facing counts of DWI and Refusing to submit to a roadside breath test along with traffic violations for speeding and moving from a lane unsafely.
Before she was released to family members Engel was issued an appearance ticket for October 30th in City Court.
34 year old Lemar Leach of North Spruce Street in the City was also arrested on East Main Street following an incident at a local business early Sunday Morning.
He was charged with DWI for having a BAC over .08 percent and was issued an appearance ticket for City Court on October 30th.

Flu season is underway, and doctors are urging New Yorkers to get vaccinated.
Health experts say this season could be a tough one based on trends from around the world.
It takes about two weeks for flu shots to be effective, so the sooner you get one, the better.
The Centers for Disease Control says this year’s vaccine is set to protect against three or four influenza viruses that are most likely to spread.
The state will release its first weekly influenza surveillance report of the season Thursday.

Senate Minority Leader Chuck Schumer is calling for a vote this week on President Trump’s decision to withdraw U.S. troops from Syria.
The New York Democrat said yesterday he believes Mister Trump’s decision could put the United States at risk of a terror attack.
Schumer says his proposed resolution would be bipartisan and have a plan to beat ISIS.
The president said he decided to withdraw the troops because it’s time to get the United States out of endless wars.

The first place Buffalo Sabres will look to keep their winning ways going today.
They’ll be hosting the Dallas Stars this afternoon at KeyBank Center.
The Sabres are coming off a shootout win over the Florida Panthers Friday and have won four of their first five games.

Batavia City School Board President Endorses in City Court Election.

Weekend News Briefing

The Batavia Police Department and Genesee County Sheriff’s Office has been outfitted with an armored vehicle by the US Government.
The vehicle was procured through the federal 1033 program which allows for departments across the nation to receive surplus military vehicles, for free, to use in special operations.
The MRAP vehicle which stands for Mine-Resistant Ambush Protected was designed to withstand improvised explosive devices and ambush attacks.
The vehicle will be utilized in responding to potentially dangerous situations that in the past required a swat or emergency response vehicle from another county to respond.
Chief Deputy Brian Frieday said it will also be useful in rescue scenarios…

The retrofitting process to make the vehicle suitable for law enforcement use has been estimated to cost approximately $15,000.

Three busted for drugs following a traffic stop in Byron.
Genesee County Sheriff’s Deputies took three Rochester residents into custody after they were subjected to a traffic stop on Route 33 in Byron Thursday morning.
Deputies allegedly found 47 bags of fentanyl inside the vehicle during the stop along with a large amount of drug packaging materials.
32 year old Marvelous Williams of Greece, 23 year old Chance Barnwell-McClary of Rochester and 30 year old Raquel Chin also of Rochester were all arrested and charged with Criminal Possession of a Controlled Substance and Criminal Use of Drug Paraphernalia.
After being arraigned in Byron Town Court all three were remanded to the Genesee County Jail in lieu of bail.

An Oakfield woman arrested for fraudulently taking benefits.
28 year old Megan Ranlett of Gibson Street in Oakfield is facing counts of Forgery, Offering a False Instrument for Filing and Petit Larceny.
She is accused of filing false information on an application for Social Service Benefits which she received based on that information.
She is expected back in Batavia Town Court on November 7th.

City wide leaf collection will begin October 21st and will continue until November 22nd.
Residents on Clinton, Oak, Main, Pearl and Walnut Street along with Richmond Ave may rake leaves to the parkway, but do not place them in the street.
If your street has a route number, please keep leaves out of the roadway and all others are asked to rake leaves close to the curb line.
Any resident with leaves can also bring them to the yard waste station until it closes for the season on December 14th.

New York State Police are conducting special traffic enforcement efforts for this Columbus Day Weekend to crack down on speeding and impaired motorists.
The Columbus Day campaign began on Friday, October 11th and will run through Monday, the 14th.
Troopers expect increased traffic volume during this weekend due to the holiday weekend and fall tourism, which poses additional risks on roadways state wide.

The Batavia Police Department and Genesee County Sheriff’s Office Receive New Rescue Vehicle

The Batavia Police Department and Genesee County Sheriff’s Office has received an armored rescue vehicle from the US Government’s 1033 program. The program allows for departments across the nation to receive surplus military vehicles, for free, to use in special operations. The vehicle received is called an MRAP which stands for Mine-Resistant Ambush Protected. The vehicle was designed to withstand improvised explosive devices and ambush attacks. Due to its larger size, heavy weight, and big tires, it is also a perfect vehicle to use during flood situations and natural disasters. The departments will take possession of the vehicle today and will begin retrofitting it with the necessary equipment to include paint, decals, lights/sirens, seating and communications to make it suitable for law enforcement use. The departments plan to use the vehicle for a multitude of duties to include, rescue operations during floods or natural disasters and high-risk law enforcement activities such as active threats/warrant executions, throughout the county. This new addition will allow the departments to provide better protection to citizens in natural disaster situations and also protect officers who are involved in higher risk law enforcement activities. The Batavia Police Department and Genesee County Sheriff’s Office are proud to have this vehicle which better prepares the City of Batavia and Genesee County for any threat, both natural and man-made.

Bureau of Maintenance: City wide leaf collection

Press Release:

City wide leaf collection will begin October 21, 2019 and will continue until November 22, 2019.

Residents of the following streets can rake leaves to the parkway, but do not place in the street; these streets are Clinton Street, Oak Street, Main Street (including East and West Main Street), Pearl Street, South Main Street (between Oak St. and Walnut St.),Walnut Street, Richmond Ave (between Oak St and Prospect Ave). If your street has a route number (i.e. Route 5, Route 33, Route 63 and Route 98), then please keep leaves out of the roadway.

All other streets are asked to rake leaves close to the curb line, taking care not to block storm drainage structures/catch basins or not to block travel-way of streets.

Leaf operations typically have one crew on the Northside working from Grandview Terrace moving West, North of Main Street, and a second crew on the Southside beginning on River Street moving East in areas South of Main Street. A third crew will work using a vacuum along main roads and numbered routes. It takes about 2 weeks to go through the entire city.

Any resident with leaves can also bring them to the yard waste station until it closes for the season on December 14, 2019. Beginning November 4, the Yard Waste Station hours will be adjusted to 11AM to 5 PM Monday through Saturday. The Yard Waste Station is closed on Thursday, November 28, for Thanksgiving.

IMPORTANT INFORMATION ABOUT LEAF COLLECTION:

  • Leaf piles must be clear of sticks and other debris.
  • Leaf piles must be clear of all animal waste – if animal waste is found in the piles, they will not be picked up
  • Grass clippings, Flower potting’s, Branches, Pumpkins cannot be picked up and residents may bring those items to the Yard Waste Station on Law Street (which will be open through December 14, 2019)
  • Leaves should not block traffic.
  • Leaves should not be piled near intersection corners. This causes sight issues for motorists/bicyclists/pedestrians.
  • Keep leaf piles clear of drainage ways and catch basins. Blocked drainage leads to localized flooding.
  • Leaves should not be piled around mailboxes, power poles, fences, fire hydrants or other obstacles.
  • Do not park on leaf piles. The heat from a vehicle exhaust system could start a fire.
  • Do not wait to get your leaves out. We will normally collect leaves twice within the month of leaf collection.
  • If it is snowing, we plow first. If it continues to snow, then leaf operations will be suspended.
  • There is no leaf pickup in the spring.

Morning News Briefing

Two Orleans County residents were killed in a crash on Route 104 in Gaines after hitting a deer and driving into a creek according to authorities.
Orleans County deputies received the report of a motor vehicle accident with injury at 6:49 yesterday evening.
According to investigators, 21 year old Brooke Allen of Lyndonville was driving a 2000 Nissan Sedan down Route 104 in Gaines when her vehicle struck the animal.
The impact sent the vehicle across both lanes of traffic, over a guardrail, down an embankment and into a creek.
First responders arrived to find the overturned vehicle submerged in 5 to 6 feet of water.
Both Allen and her passenger, 20 year old Richard Forder of Albion, were pronounced deceased at the scene.
Investigation into the crash continues.

Buell Street pair jailed after being stopped driving on 33 suspensions with drugs

Two Buell Street residents are behind bars after being stopped for an alleged traffic violation on North Spruce Street in the city.
City Police stopped 54 year old David Vega Tuesday night for having an unsecured front plate and a brief roadside investigation Officer’s discovered that Vega was driving on a suspended and revoked license.
He reportedly had 33 suspensions and revocations of which 30 were on 20 separate dates.
28 year old Jennifer Hogan also of Buell Street was a passenger in the vehicle and was allegedly in possession of drug paraphernalia, Marijuana and an open container of Corona beer.
Vega was charged with Aggravated Unlicensed Operation in the first degree while Hogan was hit with counts of Criminal Possession of a Controlled Substance, Criminal Use of Drug Paraphernalia, Open Container and Unlawful Pot Possession.
Both were committed to the Genesee County Jail in lieu of $10,000 bail a piece.

Plans to build a new $65 million jail facility have been put on hold following the latest meeting of the Genesee County Legislature.
Local lawmakers agreed to hold off on plans until Gov. Andrew Cuomo signs sales tax agreement legislation that is necessary for the county to fund a new facility.
The county and city came to a 40-year sales tax agreement that will generate the revenue to pay back loans that are needed for construction.
Speaking with our news partner The Batavian, Chairman Robert Bausch said that piece of legislation is waiting for the Governor to request it…

The entire process of approving a sales tax agreement would need to start from the beginning next year if the bill isn’t approved before December 31st.
Bausch said most of the planning phase has been completed and they are ready to move if the legislation is passed.

City School’s go on a temporary lock-out as a Batavia man is apprehended for strong-arm robbery.
The Batavia Police Department was informed of a strong-arm robbery at the Days Inn hotel on Oak St. late Sunday night.
44 year old Thomas Moynihan of State Street in the city was the prime suspect according to Batavia Police and he allegedly entered the hotel, demanded money from the front desk clerk and as Moynihan fled, he fought with the clerk.
The clerk was uninjured and Moynihan made off with less than $500.
He was spotted on Monday near the Batavia High School campus and as a precaution, the school was placed in lock-out, not allowing anyone in or out of the building until Moynihan was safely in custody.
He is facing counts of Robbery, Burglary and Harassment.

State officials claim the agency didn’t do enough to regulate water levels on Lake Ontario this year.
As a result, folks living along the shoreline had to deal with severe flooding that caused extensive damage.
The lawsuit is asking for compensation for cleanup after the waters receded.
As a reminder, those affected by flooding can still apply for financial assistance through the Lake Ontario-St. Lawrence River Flood Relief and Recovery program until October 31st.

The hot start to the season by the Buffalo Sabres continues, thanks to some overtime heroics.
Marcus Johansson scored a minute and 30 seconds into OT as the Sabres beat the Montreal Canadiens five-to-four at KeyBank Center last night.
Jack Eichel also had a pair of goals for the Sabres, who have won three of their first four contests.
They’ll be back on home ice tomorrow night to take on the Florida Panthers.

Governor Cuomo is calling for the federal government to step up and take action on the nationwide vaping crisis. The governor made the request after announcing a 17-year-old from New York City is the first Empire State resident to die of a vaping-related illness.

36 year old Kristofer Hubbard of Silver Springs, and 34 year old Dustin Hernandez of Castile have been arrested in the case.
Hubbard is accused of setting up a drug deal through another dealer and lying about it to police. Hernandez is facing charges of Tampering with Physical Evidence and Hindering Prosecution.
Both are being held in the Wyoming County Jail.

HAWLEY LAUDS BREAST CANCER AWARENESS MONTH, EARLY DETECTION TO SAVE LIVES

In honor of October as Breast Cancer Awareness Month, Assemblyman Steve Hawley (R,C,I-Batavia) is calling on individuals to embrace education and early detection as primary mechanisms to fight the disease. According to the Centers for Disease Control and Prevention, breast cancer is the second-most common cancer among women in the U.S. and at the top of new cancer cases reported in New York in 2016.

“As we all come together to emphasize our constant fight against breast cancer this month, it is critical to impart on the public that early detection is the key to beating this disease,” Hawley said. “There are countless state and local programs, support groups and resources available to the public including through the Breast Cancer Coalition of Rochester (BCCR) as well as a free screening program that is part of state law to cover ineligible or uninsured women.”

Independent Living and four partners bring Universal Design expert to Batavia

Independent Living of the Genesee Region (ILGR) and governmental and community organizations are sponsoring a seminar on Universal Design and Aging in Place. The focus is designing communities which meet citizens’ needs and behaviors across the lifespan and the ability span. This is achieved by building places which are both functional and attractive for those with and without disabilities.

We are bringing a nationally recognized expert on the topic, Esther Greenhouse from Cornell University’s College of Human Ecology, to speak on “Creating Thriving Communities: from Vision to Reality”.

Her workshop for professionals and community members will be presented on Wednesday October 23, 2019 at Genesee Community College, Conable Building, Room T102, One College Road, Batavia, NY 14020. Registration begins at 7:30 AM, with the lecture from 8:00 to 11:30 AM. Refreshments will be provided. The cost is $25.00 per person. Pre-registration is appreciated, not required.

An environmental gerontologist, a designer, and a built environment strategist, Ms. Greenhouse will deliver an engaging and informative presentation on design, planning, aging services, government policy, housing & development. A breakout session follows, where attendees will explore applying the Enabling Design Approach to benefit the community. Afterwards, they will have a powerful perspective as well as resources to apply to development projects, to address policy barriers and levers, and to apply for funding. Continuing Education Units (CEUs) will be available at this event for select associations.

Did you know that the design of your community’s housing and infrastructure creates unnecessary challenges for you, your family, your fellow citizens and your community? ILGR celebrated the 29th Anniversary of the monumental Americans with Disabilities Act of 1990 in July, which barred discrimination against individuals with impairments in a variety of situations. However, the vast majority of the infrastructure in our nation, public and private, was constructed before 1990, when many stairs, fairly narrow doorways, round doorknobs, cramped bathrooms and poor public transportation were typical, and few other than healthcare facilities had made accessibility a serious consideration. With the “Baby Boom” generation – about 78.3 million of them — aging out at an accelerated rate, and the youngest of them now entering their late fifties, there is a need for much greater accommodations.

Offices for the Aging nationwide have strived for decades to provide services and supports which encourage community living, allowing older adults to remain in the homes of their choice for as long as possible, as independently as possible. Genesee County’s recent countywide comprehensive housing needs assessment clearly indicated a need for more accessible housing. Genesee and Wyoming County Offices for the Aging are proud to be a part of this collaborative effort.

Bergen, NY – Byron-Bergen High School Principal, Pat McGee, has officially announced that Siomara Caballero has been named a Commended Student in the 2020 National Merit Scholarship Program. Caballero received a Letter of Commendation from the school and National Merit Scholarship Corporation (NMSC), which conducts the program, along with a personal congratulations from Principal McGee.

“Siomara is an exceptional student,” said McGee. “Placing in the top 3% out of 1.5 million students is an amazing accomplishment and a reflection of her hard work and dedication. We are all very proud of her.”

About 34,000 Commended Students throughout the nation are being recognized for their exceptional academic promise. Commended Students placed among the top 50,000 scorers of more than 1.5 million students who entered the 2020 competition by taking the 2018 Preliminary SAT/National Merit Scholarship Qualifying Test (PSAT/NMSQT).

In addition to being named a Commended Students in the National Merit Scholarship Program, Caballero was recognized by the College Board as a National Hispanic Scholar, which means that she scored within the top 2% of all Hispanic students in the nation on the PSAT.

Outside of the classroom, Caballero is a member of the Math League, Cross-Country team, Track and Field team, Varsity Basketball team, PageTurners, National Honor Society, and Spanish Club.

“I don’t know exactly what I’m going to do after graduation, but I’m definitely going to college to study math or physics,” said Caballero. “Thanks to all my teachers and family for helping me in my academic pursuits.”

BPD: Arrest Made in Hotel Robbery

On 10/06/2019 at approximately 11:30 PM, the Batavia Police Department was informed of a strong-arm robbery which had just occurred at the Days Inn hotel on Oak St. Officers responded and were informed the suspect had fought with the clerk while trying to get away. The clerk was not injured. The suspect was able to flee after taking less than $500.00 from the business. A suspect was quickly developed through the investigation, but attempts to locate him at the time were unsuccessful.

Thomas P. Moynihan, age 44, of State Street, Batavia, NY was arrested, without incident, on 10/07/2019 after being spotted near the Batavia High School. The surrounding schools were placed in a temporary lockout status (no one in or out of the building) as a precaution until Moynihan was in custody. Moynihan was charged with PL 140.20 – Burglary 3rd, PL 160.05 – Robbery 3rd, PL 155.25 – Petit Larceny and PL 240.26-1 – Harassment 2nd. Moynihan was arraigned in Batavia City Court before Judge Balbick on 10/08/2019 at 9:30 AM.

Albion resident, 33 year old Andrew Campbell is facing serious prison time after pleading guilty to possession of child pornography.
In federal court yesterday Campbell admitted to possessing images and videos of child porn after the disturbing material was found on several of his electronic devices by forensic investigators.
A former housemate of Campbell contacted the Orleans County Sheriff’s Office after discovering a disturbing video on a desktop computer that belonged to the defendant back in June of 2018.
Campbell left the computer and other devices at the residence that were later turn over to lawmen after he was made to vacate the residence by the witness.
Investigators searched a desktop computer, a laptop and hard drive discovering more than 65 image files and 20 videos containing child pornography.
Campbell is scheduled to be sentenced in January where he faces a maximum of 20 years in prison along with a $250,000 fine.

Two behind bars following investigation into an overdose death in Perry.
Investigation into a suspected heroin overdose death in the Town of Perry in September has landed both 36 year old Kristofer Hubbard of Silver Springs, and 34 year old Dustin Hernandez of Castile in the Wyoming County Jail.
Hubbard is charged with Criminal Sale of a Controlled Substance and Hindering Prosecution for allegedly setting up a drug deal for another dealer and lying to investigators about it.
Hubbard is being held in lieu of $50,000 bail.
Hernandez is facing charges of Tampering with Physical Evidence and Hindering Prosecution and was committed to jail in lieu of $15,000 dollars bail.

New York’s first vaping related death causes Cuomo to call for the federal government to step up and take action on the vaping crisis.
The governor made the request yesterday after announcing a 17 year old from New York City is the first Empire State resident to die of a vaping-related illness.
Last month, the governor called for a ban on the sale of flavored e-cigarettes, but that’s on hold pending an October 18th court hearing.
The vaping industry says the illnesses are connected to illegal products and they’re being unfairly punished.

The Buffalo News reports he’s sent an e-mail to friends and associates, asking them to reach out to the judge handling his federal insider trading case. In the e-mail, Collins said it’s important for the judge to get letters highlighting his years of public service and accomplishments. Collins, who represented the 27th District, is facing up to 57 months in prison when he’s sentenced in January.

A suspected assault at a Darien Lake rap concert.
20 year old Lauren Smith of Lockport was arrested on Sunday for assault. Her alleged victim claimed she was punched by Smith at the September 15th concert breaking her law.
Smith was charged with second degree assault and released with a court appearance ticket.

A new poll shows a majority of Empire State residents support a push to ban the sale of flavored e-cigarettes.
Sixty-one-percent of people surveyed by Siena College are behind that idea, while 52-percent of folks support banning all e-cigarette products.

Genesee County Health Department offers FREE Anti-Rabies Vaccination Clinic at LeRoy Highway Garage

The Genesee County Health Department is holding a free anti-rabies immunization clinic on Thursday, October 17th, from 4 to 7 p.m. at the LeRoy Village Highway Garage, 58 North Street, LeRoy. Vaccinations are free for dogs, cats and ferrets. Each animal must be leashed or crated and accompanied by an adult who can control the animal. Voluntary donations are accepted.

Investigation into an Assault complaint by the Genesee County Sheriff’s Office has resulted in the arrest of a Lockport woman.
20 year old Lauren Smith of Strauss Road Lockport was arrested and charged with Assault in the 2nd degree after a complaint was filed Sunday from the victim.
While she was attending the Meek Mill and Future Concert at Darien Lake Performing Arts Center last month she allegedly punched a female victim in the face and broke her jaw.
Smith was arraigned in Darien Town Court and was released with a ticket for Darien Town Court on October 17th.

An alleged domestic incident at a Batavia apartment lands Bergen man in lock-up.
22 year old Zackary Seeley of Lyman Road Bergen is accused of violating a stay away order of protection Sunday causing an incident in which he allegedly threw a 16 ounce bottle of Dr. Pepper at a Child.
Seeley is facing counts of Aggravated Criminal Contempt, Aggravated Family Offense and Endangering the Welfare of a Child and was subsequently jailed in lieu of $5,000 bail.

Starting today, a new pay equity law will be in place across New York State.
It means employers can no longer pay workers differently based on several factors including sex, marital status or military service history.
People with a similar line of work also have to be paid the same, even if their responsibilities are different.
A spokesperson for Governor Cuomo says the measure will also prevent women from being paid less than men who have the same job.
Data shows New York already has one of the narrowest gender pay gaps in the country.
One goal of this new legislation is to close that interval even more.

Batavia, NY — Saturday night (Oct. 5) will be one that Oakfield, New York native Mike Caprio will never forget because he captured his career milestone 2,000th driving win with his own prized trotter BZ Glide in the featured $12,500 Brian Schroeder Memorial Trot at Batavia Downs.

After a two month summer vacation and one qualifier back, BZ Glide left from the pylons and cut fractions of :28, :58.3 and 1:28.1 before turning for home and holding off all challengers under a line drive by Caprio to win in a season’s best 1:57.4.

The win was a true family affair as BZ Glide ($5.40) is owned by the Caprio Stable and is trained by Mike Caprio’s wife, Alana.

Caprio got his driver’s license in 1981 and has been competing full time ever since. His first driving successes came behind two main horses; his father Joe Caprio’s prized pacer Prosecutor and a horse he owned with his dad, Connecticut Glove.

Prosecutor (Flying Bret-Chuck’s Maid 1:59.3, $104,902) was a 58-time winner lifetime and a top class pacer in western New York for many years, winning 39 of those races on that circuit with the younger Caprio at the lines.

Connecticut Glove (Bullet Hanover-Congress Glove 2:00.3, $211,261) was a hard-knocking over-nighter who won 43 races lifetime, 20 of which had Caprio in tow.

Since the early years Caprio has owned 57 horses and had much success with many of them, but the one that stands out as the shining star of his career was his 2,000th winning drive, BZ Glide.

BZ Glide (Yankee Glide-Bloomer Zoomer 1:56.1, $339,847) was purchased as a 2-year-old by Caprio and his wife Alana and they developed him into one of the best Open class trotters to ever compete in western New York. Now 10-years-old, BZ Glide has won 45 races with Caprio at the helm and has been the cornerstone of their operation during that time.

Caprio has also been responsible for much of the driving success of another western New York 56-time winning star, Fireyourguns (American Ideal-Villa Hanover 1:47.3, $406,886) who is trained by Terence Mc CLory.

Besides driving his own horses, Caprio has always been a very popular catch driver throughout his career. As a result he has scored 2,000 wins out of 14,904 starts with 1,829 seconds and 1,839 thirds and has earnings of $4,942,824. His highest earnings year was 1989 ($251,170) and he scored his most wins in 1988 (129).

Batavia Downs draw schedule changes made

Batavia, NY — With the final matinee card of racing at Batavia Downs coming up on Columbus Day (Monday, Oct. 14) and no racing the following Wednesday, horsemen are advised of the following changes in the draw schedule for the upcoming week.

The draw for Friday (Oct. 11) will be held on Tuesday (Oct. 8).
The draw for Saturday (Oct. 12) will be held on Wednesday (Oct. 9).
The draw for Columbus Day Monday (Oct. 14) will be held on Thursday (Oct. 10)

The draw for Saturday (Oct. 19) will be held on Wednesday (Oct. 16).

Morning News Briefing

A crash in Orleans County that left three people dead continues to be investigated by State Troopers.
According to State Police the accident occurred on Route 63 in Shelby Saturday morning when a southbound U-Haul van apparently crossed the northbound lane and struck a pickup truck.
Both the van and the truck reportedly left the roadway and caught fire.
Police have identified 80 year old Charles Stevens and 57 year old Jeffrey Johnson, who were occupants of the U-Haul truck as deceased.
The pickup truck driver’s identity has yet to be released.

A Batavia woman busted for illegally possessing a shotgun and endangerment.
City Police report the arrest of 52 year old Patsy Rapone of Meadowcrest Drive following investigation into a domestic incident.
Rapone, who is a convicted felon was allegedly found illegally possessing a shotgun and charged with Criminal Possession of a Weapon and additionally was charged with Endangering the Welfare of a Child after an investigation into an incident late last month at a Meadowcrest Drive address.
She was released under supervision of Genesee Justice with appearance tickets for City Court on October 17th.

Two arrested for aggravated drinking and driving in Genesee County over the weekend.
Genesee County Sheriff’s Deputies arrested 34 year old Stephen King of Rochester Saturday night following a traffic stop on Lake St in Bergen. King was charged with Aggravated DWI for having a blood alcohol content over twice the legal limit and will appear in Bergen town court on October 30th.
48 year old Jeremy Carlson of Sumner Road in Darien Center was arrested after a stop on Pearl Street in the City after several allegedly speeding and failing to keep right.
He was charged with Aggravated DWI along with Drinking Alcohol in a Motor Vehicle on a Public Highway and was ultimately released with an appearance ticket for City Court on October 23rd.

Counselors will be on hand in the Brockport Central School District today to help students and staff mourn the death of a teacher.
Monroe County deputies say 46 year old Carolyn Ray was struck by a pickup truck while riding her bike on Sweden Walker Road in Clarkson Saturday.
Ray was rushed to the hospital but died hours later of her injuries.
Police say the pickup truck driver wasn’t hurt and drugs and alcohol don’t appear to be factors in the tragedy.
The cause of the accident is under investigation.

It wasn’t easy, but the Buffalo Bills are back on the winning track.
Bills quarterback Josh Allen returned from injury to throw a pair of touchdowns in Buffalo’s 14 to seven road win against the Tennessee Titans.
Duke Williams ended up with the game-winning score with less than 10 minutes left in regulation.
The Bills are now four-and-one on the season.
Up next, they host the winless Miami Dolphins at New Era Field on October 20th.

Batavia, NY — A pair of $9,000 claiming/conditioned trots topped the card at Batavia Downs on Friday night (Oct. 4) and the winner of each took a different route to victory.

Call My Broker (Jim Morrill Jr.) took full advantage of his pylon post position and seated the field off the gate. Then, after cutting moderate fractions of :28.4, :59.3 and 1:29.1, Morrill kept Call My Broker rolling down the lane and held off the pocket-sitting Barn Winner (Ray Fisher Jr.) to win by three quarters of a length in 1:58.3.

Call My Broker ($3.60) scored his fourth win of the year for owner Frank Meier and trainer Angelo Nappo.

Later in the other division, Alert Hanover (Shawn McDonough) started from post two and opted to stay there, taking the garden spot trip behind Golden Tate (Jim Morrill Jr.) from the start to the top of the lane where Golden Tate made a break he did not recover from. McDonough directed his horse around the off-stride trotter and cruised home on top by a length, also in 1:58.3.

Winning his fourth race of the year as well, Alert Hanover ($6.80) was owned by Carl Kuepfer and trained by Patrick Shepherd until the race ended when he was claimed.

A Trio arrested in Batavia for driving with drugs and a firearm with an unseated 10 month old child.
34 year old Trevon Armstrong of Denio Street Batavia, 28 year old Gabrielle Chaplin of Porter Ave Batavia and 27 year old Darius Jones of Attica were all arrested following a traffic stop on East Ave at Ross Street in the City.
The trio was stopped by deputies Wednesday afternoon after allegedly failing to use a turn signal.
Investigation of the vehicle revealed they were allegedly in possession marijuana, oxycodone and a loaded handgun.
A 10 month old child was also reportedly in the vehicle, not properly secured in a car seat and in proximity of the firearm.
All three were charged with Criminal Possession of a Weapon and of a Controlled Substance along with counts of Endangering the Welfare of a Child and Unlawful Possession of Pot.
Armstrong and Jones were remanded to the Genesee County Jail without bail while Chaplin was ordered to be held in lieu of 10-thousand dollars bail.

A ban on the sale of flavored e-cigarettes was set to be enforced across New York today, but retailers are getting a reprieve.
Yesterday, a court approved a request by the Vapor Technology Association and affiliates for the ban to be put on hold until another court hearing later this month.
Vape shop owners believe the ban would hurt their sales, since flavored products are popular among customers.
The state Health Commissioner said yesterday’s decision won’t stop New York from trying to put an end to teen vaping and vaping-related illnesses.

Not guilty verdict in Antwan Odom case

19 year old Antwan Odom of Batavia has been found not guilty on all counts after being accused of assaulting his former teammate.

A Genesee County jury of nine women and three men returned the not guilty verdict late this morning.

Odom was accused of assaulting his former teammate and friend Ray Leach on Aug. 4th of 2018, during an incident on Ross Street.

The verdict was unanimous on charges of first and second degree Assault, Attempted Assault as well as Criminal Possession of a Weapon.

The Genesee County Jury hearing the case against former Batavia football star Antwan Odom will continue its deliberations today.
The jury consisting of nine women and three men recessed yesterday after spending four hours in the jury room.
The 19 year old Odom is accused of stabbing his neighbor and former teammate Ray Leach on Ross Street last year.
District Attorney Lawrence Friedman says the stabbing happened following a dispute over money while Defense Attorney Frank Housh maintains Leach was actually the aggressor in the altercation.
Odom is facing a first degree assault charge which if found guilty of would end with a prison sentence of no less than five years behind bars.
Odom could still avoid jail time if he is granted Youthful Offender Status by Judge Charles Zambito.
The 12 jurors are expected to resume deliberations at 9 a.m. this morning.

City residents are being reminded to secure their vehicles following a number of larcenies from vehicles reported to Batavia Police.
Over the past few weeks the Department has received multiple reports of larcenies from vehicles all throughout the City with culprits allegedly stealing cash, GPS units and other electronic items.
According to investigators the string of larcenies are believed to have been committed by a group of bicycle riders walking and riding through local neighborhoods in the night.
Police encourage locking unattended vehicles and say residents should not leave items of value in vehicles overnight.
Residents are also encouraged to report any suspicious activity to Police.

The son of former Representative Chris Collins pleads guilty to conspiracy.
Cameron Collins is looking at the possibility of a near four year prison sentence after he and his future father-in-law pleaded guilty to conspiracy to commit securities fraud in a federal court yesterday.
His father Chris Collins pleaded guilty in connection with an insider trading scheme on Tuesday and could face up to 57 months behind bars.
Collins resigned from his seat as the representative in the 27th Congressional District on Monday, leaving it vacant.
All three men will be sentenced in January.

New York’s statewide ban on flavored e-cigarettes is being put on hold.
The New York Appellate Court granted a temporary restraining order yesterday against the enforcement of the ban, which was slated to go into effect today.
The Vapor Technology Association filed suit to stop the policy, and the temporary hold will give the court more time to consider the lawsuit.
The ban is expected to be at a halt until the parties are due back in court on October 18th.

The Buffalo Sabres have kicked off their 50th Anniversary season in style.
They beat the Pittsburgh Penguins on the road last night by a final score of three-to-one.
Former Penguin Conor Sheary led the way for Buffalo, scoring a pair of goals.
Up next for the Sabres is their home opener tomorrow against the New Jersey Devils.
Face-off for that contest is set for 7:00 p.m.

The Buffalo Bills will look to get back to their winning ways this weekend.
They’ll be traveling to take on the Tennessee Titans at Nissan Stadium in Nashville.
The Bills were unbeaten until falling to the New England Patriots last Sunday.
Quarterback Josh Allen was also hurt in that game and his status for this contest is in question.
If he can’t start, backup QB Matt Barkley will be under center. Kickoff for Sunday’s game is 1:00 p.m.

The jury that heard the case against former Batavia High School star athlete Antwan Odom has recessed for the day.
The jury of nine women and three men will resume deliberations tomorrow morning.
The 19 year old Odom is accused of first degree assault in the knife attack last summer on former teammate Ray Leach.
A conviction on first degree assault carries a mandatory minimum of no less than five years in prison. The jury could, however, find Odom guilty of a lesser charge or find him not guilty of any wrongdoing.

The son of former Congressman Chris Collins pleads guilty to conspiracy to commit securities fraud.
Cameron Collins and Stephen Zarsky, the father of Cameron’s fiancé, were in federal court in Manhattan today. Both pleaded guilty to the same charge. Each faces up to five years in prison. Chris Collins faces up to 10 years in prison after pleading guilty earlier week.
Prosecutors say Chris used non-public information from an Australian biotech firm to tip off his son to sell stock in the firm in advance of a failed clinical trial and passed that information onto his son.

A Pavilion man arrested for allegedly stealing a generator from Home Depot.
Deputies say 41 year old Jason Mckenzie of Covell Road Pavilion took the generator from the Home Depot in Batavia while his daughter was with him. Authorities said McKenzie was later arrested trying to sell the generator at a pawn shop. He was charged with Petit Larceny along with Endangering the Welfare of a Child.

Nearly a year after a limo crash in Schoharie left 20 people dead, the NTSB has released a new report on the tragedy.
In it, officials said some of the passengers in the vehicle may have survived if they were wearing seat belts.
Most of the belts in the vehicle were under the seats and not visible to passengers.
The NTSB is now recommending the state make it mandatory that all motor vehicle passengers wear seat belts.

The Buffalo Sabres will be kicking off their 50th Anniversary season tonight. They’ll be on the road, visiting the Pittsburgh Penguins. The teams squared off this past weekend in preseason action, with the Sabres coming out on top. Face-off for tonight’s contest is set for seven p-m. Batavia, NY — Although the weather turned decidedly cooler after the rain on Wednesday (Oct. 2) in western New York, driver Drew Monti was red hot at Batavia Downs as he won six races on the card, including a natural Grand Slam in races three to six.

Monti visited the Purple Haze Winner’s Circle with A J Cash (2:01, $2.70), Rock N Roll Rosie (1:57.3, $8.40), Our Art And Heaven (1:59.2, $4.60), Cracked Glass (1:58.4, $9.10), Terlingua (1:56.3, $19.60) and Tymal Luckynpink (1:57.2, $3.90).

Monti hit the board with a second and a third as well giving him a .530 Universal Driver Rating (UDR) for the night.

Over the last six race nights at Batavia Downs, Monti has been the winningest driver on the grounds with 10 victories in 33 starts giving him a win percentage of 30%, and including his five seconds and four thirds, he has a UDR of .428 during that same time.

The feature race for the night was the $12,000 Fillies and Mares Open Handicap that saw Little Joke (Billy Davis Jr.) leave from post seven to take the lead and keep it throughout the mile and win by 2-1/4 lengths in 1:56.1.

It was the seventh win of the year for Little Joke ($15.00) who is owned by Vogel and Wags Nags Stable and Jack Rice. Maria Rice trains the winner.

Davis had two more winners on the card beside the feature giving him a driving hat trick as well.

BATAVIA, NY… The no.10 nationally-ranked Genesee Community College women’s soccer team defeated the Jamestown Community College Jayhawks 9-0 Wednesday night as the Cougars honored their sophomore class prior to the Western New York Athletic Conference contest.

Three goals and an assist from Julia Ashworth powered the Cougars offense. Alexa Jordan would score two goals with Madison Papaj, Diante Scheepers, Sarah Gregori and Khiva Huxhold all scoring a goal for the Blue and Gold. Assisting on the goals were Diante Scheepers, Alana Wilson-Drewery, Ashley Hearn, and Autumn Ressue.
Alexa Salatel recorded the shutout in net for Genesee.

Genesee (8-3) returns to action on Saturday, October 5 at 12:30pm as they travel to Herkimer College to play the Generals.

BATAVIA, NY… The no.6 nationally-ranked Genesee Community College men’s soccer team defeated the Jamestown CC Jayhawks 5-0 in NJCAA Region III soccer action Wednesday afternoon.

Ollie Ardle scored on a PK to put the Blue and Gold on the board. Hiago Barros de Souza found the back of the net off his own corner kick to double the Cougars lead. National player of the Week Ed Port scored halfway through the second half to increase the Cougars lead to 3-0. Barros de Souza would score his second of the game with Port getting the assist to widen the lead to 4-0. Peter Rystad would score off a Futa Kubo assist to finish the scoring.
Marcus Kenline and Adam Willig split time in net to record the shutout.

Arguments abounded as the trial against former Batavia High School Football star Antwan Odom continued into day three.
The focus was on the lawyers in day three of the trial according to our news partner, The Batavian, with a clearly contentious relationship between defense Attorney Frank Housh and District Attorney Lawrence Friedman.
Housh presented a seemingly convincing closing statement with a reportedly sympathetic looking jury only to be torn apart point-by-point with Friedman’s closing statement.
Odom is accused of stabbing former Batavia football teammate Ray Leach in an altercation in the summer of 2018 to which defense attorney Housh maintains that Leach was not the victim but the aggressor.
Odom is facing a felony count of first-degree Assault and the jury is expected to start deliberations today.

Alleged shoplifting with a kid at Home Depot leads to charges for Pavilion man.
Following an investigation into a stolen generator from the Home Depot Store in Batavia, Genesee County Sheriff’s Deputies arrested 41 year old Jason Mckenzie of Covell Road Pavilion.
Mckenzie was with his daughter when he allegedly stole the generator from Home Depot earlier last month and was apprehended Monday while he was trying to sell the stolen merchandise at a pawn shop.
He was charged with Petit Larceny along with Endangering the Welfare of a Child and was released with appearance tickets for Batavia Town Court on October 17th.

Deputies arrested 20 year old Austin Kotarski of Batavia after investigation into a motor vehicle accident on Lewiston Road in Alabama.
Kotarski is facing counts of Driving While Ability Impaired by Drugs along with traffic and vehicle infractions for Moving from a Lane Unsafely and having an Uninspected Motor Vehicle.
After being processed at the Genesee County Jail Kotarski was released with appearance tickets for Alabama Town Court.

He made the announcement yesterday after data revealed a 28 percent drop in new HIV cases since 2014.
That’s the year the state launched an aggressive campaign to make sure people living with both HIV and AIDS get the support and treatment they need to live healthy lives.
It’s projected the AIDS epidemic in New York may be over by the end of 2020.

My plans are to continue moving the city forward in redevelopment and revitalization, in order to create a ‘Better Batavia’”.

First Ward Councilperson, local developer and businessman, Paul Viele said his focus in his upcoming term, if re-elected, will be to work with City Administration and his fellow Council members to continue their efforts to reduce crime in the City, revamp infrastructure throughout the City, focus on our local youth and continue to keep taxes down. “I encourage all the residents of the 1st Ward to continue to reach out to me with their concerns. 2nd Ward Councilperson Patti Pacino, who is retired and an active volunteer with local organizations, including being a Past President and current Director of the local Zonta Club; stresses several ongoing issues that she will be focusing on if elected to a third full term on Council, having been a member since 2010. “Safety is my first concern for City residents. We have had some real trouble (stabbing, etc.) which needs to continue to be addressed. Happily, the Police Department and the City are working together to get a handle on how to best deal with this. I am aware of two neighborhoods that are in the process of organizing groups similar to the Summit Street Neighbors who work together to keep police and each other in the know about trouble on their streets and what they can do about it. I will continue to support these efforts. Second, we need to continue to work on the ‘Zombie House” problem in the City, (caused by absentee landlords), to ensure our neighborhoods are not on a downfall. We have proportionately too many rentals compared to homeowner held houses, often by landlords not willing to take responsibility for their properties. Third, I will continue to work with the BID organization to upgrade the business district, organizing community activities and work with business owners to upgrade our downtown area, hopefully bringing in more businesses to fill those empty buildings and make downtown a more welcoming and prosperous area. Fourth I will continue to promote fiscal responsibility throughout City government. All these ideas that we’ll continue working on require financial support; my hope is to improve our area without burdening the area taxpayers.”

Retired Military Veteran and 4th Ward Councilperson Al McGinnis is seeking a second four year term. If re-elected, Councilman McGinnis has expressed his commitment to continued efforts to enhance the quality of life for Batavia’s residents. “We need to continue our efforts to make Batavia’s streets safe for our residents, to do all we can to increase and encourage home ownership, to renew our efforts to enforce our local codes and to continue our sidewalk and street replacement programs. LEROY JR.-SR. High School teacher named Master Teacher

Le Roy Central School is proud to announce that Jr.-Sr. High Science teacher, Mr. Michael Chiulli was one of the 228 educators from across the state selected to join the New York State Master Teacher Program. Former Republican Congressman Chris Collins is waiting to find out how long he could be behind bars.
Collins, who represented the 27th District, pleaded guilty yesterday to two felony counts in connection with an insider trading scheme.

Collins will be sentenced in January and is looking at a possible 4 and 3/4 years in federal prison per his plea agreement according to the Buffalo News.
Governor Cuomo says he’s considering calling for a special election following the resignation of the 27th Congressional District representative.
During a radio interview yesterday, the governor said he’d like the election to be sooner rather than later, but didn’t announce a specific date.
Democrat Nate McMurray, who lost to Collins last year, has already said he’ll run for the position.
Several Republicans have also expressed interest.

LeRoy student arrested for messaging a threat to the school.
The Junior-Senior High School student is allegedly sent a SnapChat message threatening harm to students last Friday leading to a district wide closure and lockout.
According to LeRoy Police a parent of one of the message recipients contacted the Safe School Helpline to advise them of the threat.
After consulting with the Assistant County Attorney the LeRoy Police Department, will be charging the juvenile with Falsely Reporting an Incident in the 3rd Degree.
The matter was turned over to the Genesee County Family Court for further action.

Former Batavia athlete Antwan Odom appeared in Genesee County Court yesterday for opening statements for the first day of the trial against him.
Odom faces charges of felony first degree assault after slashing his teammate, Ray Leach, during an altercation between former teammates on the Batavia football team last summer.
According to our news partner, The Batavian, Odom’s lawyer says that while both men admitted they fought, the police would not arrest Leach, Batavia’s star player.
The trial continues in Genesee County Court this morning beginning with Leach’s physician’s testimony.

Senator Schumer calls for guidelines to help finance hemp farms.
Sen. Chuck Schumer stopped at Mills Family Farm on Ham Road in Basom yesterday to announce a new push by his office to get bank regulators to hurry up and write guidelines for banks seeking to do business with hemp growers.
Schumer sees hemp as a potential cash crop for Western New York…

The Senator continued to say that currently bank regulators are standing in the way and have been unwilling to extend credit to farmers who want to start or expand hemp operations.

Former Congressman Chris Collins pleaded guilty in an insider trading case, a day after he resigned from Congress and set off a scramble to fill his seat in his Republican-leaning district.
Collins had initially denied charges he leaked confidential information about a pharmaceutical company and was set to go to trial next year in federal court in Manhattan on conspiracy, securities fraud and other charges.
But on Monday, the court filed papers saying the Republican from western New York would be withdrawing his not guilty plea and he submitted a resignation letter to Congress.
After his plea, Collins expressed regret and said he had failed his constituents.

An arrest has been made in the social media threat that closed LeRoy Central Schools.
LeRoy Police tell WBTA they have charged a juvenile with Falsely Reporting an incident last Friday.
School officials said the juvenile was a student at LeRoy Junior-Senior High School.
The case is now being turned over to family court.

The Genesee County Economic Development Center will consider a 126,000 in tax breaks for Six Flags Darien Lake.
The park is planning a new 60-ft tall water ride expected to open next year.
The EDC says the tax break will help retain 380 jobs at the park. The EDC also noted in a statement that Darien Lake is one of the county’s largest sales tax generators.

There’s still no word yet on if Buffalo Bills quarterback Josh Allen will be able to take the field this weekend. Allen left the team’s 16-10 loss to the New England Patriots Sunday after getting hit in the head. Since he’s still in the NFL’s concussion protocol, his status for this Sunday’s game against the Tennessee Titans is unclear.

Rogers Picks-up Endorsements from Youth Leaders

Theresa Asmus-Roth, Coordinator of Genesee County’s Justice for Children Program and Captain James C. Davis, Coordinator of the County’s S.T.A.R. Program have added their names to the list of prominent individuals who have endorsed part-time City Court Judge Durin Rogers for election to become Batavia’s next full-time City Court Judge.  The Justice for Children Program is the Genesee County Agency that advocates for and give services to local children who have been victims of abuse or witnesses to violent acts, while the S.T.A.R. (Student Transition and Recovery) Program addresses the needs of local students who are facing school discipline or removal from their homes.

Juvenile Charged in LeRoy School Threat

The Le Roy Police Department, after consulting with the Assistant County Attorney is announcing today that they will be charging a juvenile with Falsely Reporting an Incident in the 3rd Degree in connection with a threat involving the Le Roy Central Schools last Friday.

Republican Congressman Chris Collins is expected to appear in federal court today after announcing he will be stepping down from his congressional seat.
Collins announced yesterday that he was resigning from the position he’s held since 2013, and now the 27th District representative is said to have a date in a New York City courtroom where he is likely to plead guilty to at least one of the charges included his indictment for federal insider trading.
Collins was initially scheduled to go on trial in February.
It remains the decision of Governor Cuomo whether to hold a special election to fill Collins’ seat for his remaining term.
If a special election is held, party leaders would select their candidates and they would need to run another campaign to be re-elected in 2020.
On the Republican line Senators Robert Ortt and Chris Jacobs along with Attorney Beth Parlato have announced plans to seek the 27th District seat.
Medal of Honor recipient David Bellavia is considering throwing his hat in the ring as well according to reports.

Summit Street man jailed without bail after allegedly threatening police.
44 year old Jon Roblee of Summit Street in the city was taken into custody by Batavia Police following a disturbance complaint at a Summit Street address Sunday night.
Officers reported he was allegedly in possession of a pipe and was quickly apprehended.
Roblee is charged with a Class E Felony count of first degree Menacing, and Obstructing Governmental Administration.
He was ordered to be held in the Genesee County Jail without bail.

GCEDC to consider incentives a new water ride at Darien Lake.
The Genesee County Economic Development Center board will consider approving incentives of approximately $126,000 for Six Flags Darien LLC at the board’s meeting Wednesday to hear plans of building a nearly $1.6 million 60-foot tall water ride called the Wahoo Wave, at the Hurricane Harbor water park which is set to open in 2020.
The project will help retain 380 jobs at one of the county’s largest sales tax revenue generators.
Thursday the board will also consider accepting an application for over 820-thousand in tax incentives from Wright Associates for an $8.9 million capital project that would include the purchase and renovation of an existing building on Wright Avenue in LeRoy.

Genesee County Congressman Chris Collins has resigned from the House of Representatives.
Multiple sources say Collins, who represented the 27th District of New York, will enter a guilty plea tomorrow afternoon in U.DS. District Court admitting he engaged in insider stock trading.

In August of 2018, Collins was charged with insider trading and lying to the FBI, along with his son Cameron and Stephen Zarsky, the father of Cameron’s girlfriend.
Collins was accused of using non-public information from an Australian biotech firm to tip off his son to sell stock in the firm ahead of a failed clinical trial for a drug that treated multiple sclerosis.
Collins was serving as a board member of the company at the time.

Collins narrowly won re-election in November of 2018 over Democratic challenger Nate McMurray. McMurray has announced plans to seek the same office again next year. State Senators Robert Ortt and Chris Jacobs along with Darien Attorney Beth Parlato have also announced plans to seek the 27th District seat on the Republican line.

Rep. Chris Collins of New York is resigning from Congress ahead of expected guilty plea, Speaker Pelosi’s office says.
Collins is slated to plead guilty in connection to an insider trading case.
The Republican Congressman is scheduled to have a court hearing in Manhattan at 3 p.m. Tuesday. He originally pleaded not guilty and will plead guilty to at least one charge, according to the U.S. District Court’s Southern District of New York.

BATAVIA, NY – The Genesee County Economic Development Center (GCEDC) board of directors will consider approving incentives of approximately $126,000 for Six Flags Darien LLC at the board’s October 2 meeting.

The company is proposing to build Wahoo Wave, a new $1.575 million 60-foot tall water ride at the Hurricane Harbor water park which is set to open in 2020. The project will help retain 380 jobs at one of the county’s largest sales tax revenue generators.

Since the company is seeking tax incentives of over $100,000 a public hearing will be conducted. The hearing will take place at 4 pm. on Wednesday, October 2, 2019 in the town of Darien.

The GCEDC board also will consider accepting an application from Wright Associates for a $8.9 million capital project that would include the purchase of an existing 139,000 square foot building on Wright Avenue in Le Roy. In addition to the land acquisition purchase, Wright Associates will invest $2 million to rehabilitate the building and $2 million to purchase new equipment. Wright Associates is seeking approximately $823,000 in mortgage, sales and property taxes.

The GCEDC Board meeting will take place on Thursday, October 3, 2019 at its offices on 99 MedTech Drive in Batavia at 4 p.m. The meeting is open to the public.

Tullow N splashes to Batavia feature pace win

Batavia, NY — A torrential rainstorm rolled into Genesee County just prior to post time and downgraded conditions to sloppy before the first race ever hit the track. But the inclement weather and less than desirable track conditions did not prevent Tullow N from imposing his will on his foes in winning the $12,500 Open Handicap pace at Batavia Downs on Saturday night (Sept. 28).

Tullow N (John Cummings Jr.) was the only leaver in the feature and Cummings took full advantage of his position. After settling onto the lead, he backed the quarter down to a pedestrian :29 flat and then further throttled-down to a :59.2 half as everyone refused to pull.

As soon as they entered the third turn, Cummings hit the gas and Tullow N looked more like himself. With a two-length gapped advantage he got to the three-quarters in 1:27.3, swung around the last turn and then just paced away in the lane to win by three in 1:56.

It was the seventh win of the year and fifth of the Batavia meet for Tullow N ($5.90) and owner Blindswitch Racing. Dave Russo trains the winner.

Russo had another training win earlier in the night with Reiki ($4.20) who he also drove in the Billings Amateur Pace.

In the $11,000 Open II pace, Mr. Euroman N (Billy Davis Jr.) went right to the front and never looked back. After cutting fractions of :27.3, :57 and 1:25.3, Davis rounded the last turn on cruise control and let Mr. Euroman N fly home in 1:55 on top by a 1-½ length margin. It was the second win in a row for Mr. Euroman N ($3.40) who is owned by Vogel and Wags Nags Stable, Jack Rice and Adelphi Bloodstock. Maria Rice trains the winner.

Drew Monti, Shawn Gray, John Cummings Jr. and Billy Davis Jr. all had driving doubles on the card. Trainer Patrick Shepherd had two wins on the training side. Since last Saturday, Shepherd is the hottest trainer at the Downs, winning nine races in only 17 starts.

Live racing resumes at Batavia Downs on Wednesday (Oct. 2) with post time at 5 p.m.

Batavia Police report the arrest of 27 year old city resident Morgan Cox following an incident at a Central Ave address over the weekend.
Cox was taken into custody in the early morning hours Saturday after he was accused of possessing drugs and Menacing a Police Officer with a Knife.
Cox is facing counts of Obstruction of Governmental Administration, Menacing a Police Officer, Criminal Possession of a Weapon and Unlawful Possession of Marijuana.
He was committed to the Genesee County Jail in lieu of $15,000 bail and is due back in City Court this afternoon.

Fatal ATV accident in Alexander.
33 year old Michelle Buckenmeyer was critically injured shortly before 12:30 Saturday morning and died later at ECMC.
Deputies tell WBTA News Michelle was driving on a private laneway off of Seward Road near her home in Alexander.
Deputies said it appeared her ATV collided with a chained barricade across the road.
Michelle was ejected from the machine.
She was taken to ECMC by Mercy Flight and pronounced dead at 4 a.m. Saturday.

Wood Street resident busted for burglary in Batavia.
25 year old Ronald Murray was arrested on a Batavia City Court Arrest Warrant for his alleged involvement in a burglary at an East Main Street apartment early last month.
Murray was charged with Second Degree Burglary and Petit Larceny and upon his arrest was additionally hit with a count of Criminally Possessing a Hypodermic Instrument after being found in possession of the suspected drug paraphernalia.
Murray was ultimately remanded to the County Clink on $15,000 bail.

A Rochester woman arrested for a bomb threat at a Batavia business.
City Police took 43 year old Shuvon Williams of Leopard Street Rochester into custody following a lengthy investigation into a bomb threat made a to a Bank Street business back in April of this year.
Williams was charged with Aggravated Harassment and the charge was worked out as part of a plea arrangement.

Rochester resident jailed for drug dealing in Stafford.
Genesee County Sheriff’s Deputies apprehended 27 year old Falan Young following a traffic stop on Clinton Street Road in Stafford last Thursday.
Young was allegedly driving on a suspended license and was found in possession of a quantity of crack cocaine and marijuana.
She was charged with Criminal Possession of a Narcotic Drug with intent to sell, counts of Criminal Possession for pot and crack cocaine along with Aggravated Unlicensed Operation.
Young was ordered to be held on $10,000 bail in the Genesee County Jail with her next court date scheduled for October 1st in Stafford Town Court.

The flawless start to the regular season by the Buffalo Bills has come to an end.
Quarterback Josh Allen threw three interceptions as Buffalo lost to the New England Patriots 16 to 10 at New Era Field.
Allen did have one rushing touchdown but later left the game after being hit in the head.
The Bills are now three-and-one, while the Patriots are four-and-oh.
Up next for the Bills is a road game against the Tennessee Titans Sunday afternoon.

ATV Accident Fatal to an Alexander Woman

An Alexander woman was killed while riding an ATV near her home.
33 year old Michelle Buckenmeyer was critically injured shortly before 12:30 Saturday and died later at ECMC.

Batavia brought in the New Year with fireworks last night at 9p at Batavia Downs.  The time was moved up to avoid potential hazards due to the high winds that arrived after midnight, the original time of the fireworks.  No reports of major damage today due to the high winds but be aware of tree limbs and downed power lines in your area.

A grand jury has indicted a man who was arrested over the summer at the August 10th Jason Aldean concert at Darien Lake.  Robert Maharrey was indicted for disorderly conduct, multiple counts of harassment for striking a female patron in the face, 2nd degree assault a class D violent felony for allegedly striking a sheriff’s deputy, assaulting a police officer a class C violent felony when he spit and struck another deputy assisting in the arrest.

Friday evening Livingston County Sheriffs were in the middle of the state wide stop DWI effort, when deputies pulled a vehicle over on 390 for speeding.  Upon further investigation a 27 year old Geneseo man Patrick Dunn was charged with DWI.  Dunn’s BAC was .25% and was further charged with felony DWI from a previous 2015 conviction.  Dunn is now being held on 1,5k bail or 3k bond and remanded to the custody of the sheriff.

Yesterday afternoon, Genesee County Sheriffs made a traffic stop in Oakfield on Lewiston road when a Rochester man, 20 year old Damian Schoonmaker of Smith Street was found to be in possession of marijuana in his 2000 Buick LeSabre.  He was charged with unlawful possession of marijuana and is scheduled to appear in Oakfield town court 1/21

A motor vehicle accident yesterday in Elba led to a lane closure around 3:30p.  Two vehicle collided at Oak orchard and Lockport roads in Elba.  Elba fire police and 2 ambulance responded along with Elba Fire dept.

New Yorkers are seeing a number of new state laws in the New Year.  Among them, a law that requires diaper changing tables in all new public men’s and women’s restrooms.

Other changes include a requirement that health insurance companies give male patients free prostate cancer screenings and that residents be allowed to return unused prescription meds to pharmacies for free.

Many homeowners will enjoy an increase in property tax rebates, of an average of more than five-hundred dollars.
